1. Introduction and Definitions
These Terms and Conditions (T&Cs) govern the use of the website www.diwa-soul.com, as well as the booking and provision of services, courses, bundles, and private events. By using the website and booking services, you agree to these terms.
Definitions:
"Single Appointment Bookings": Refers to the booking of a single, time-limited session for an individual. Only one appointment is scheduled per booking, and it is not part of a bundle or course.
"Courses": Refers to intensive courses conducted over several weeks with fixed topics, collaboratively developed with the individual.
"Bundles": Packages of services that include multiple single appointments offered at a discounted rate.
"Private Events": Custom events or services specifically tailored to the client’s request.
"Zoom Services": Services provided online via the Zoom platform.
2. Booking and Payment
Single Appointment Bookings, Bundles, and Courses:
Booking is exclusively through the website.
For bundles and courses, only the first appointment is selected and confirmed during the booking process. Subsequent appointments may not necessarily occur on the same weekday or at the same time as the initial appointment.
Payment must be made in advance via the payment methods offered on the website, including Stripe.
Private Events:
A private event booking becomes binding once a deposit of 25% of the total amount is received within 14 days after the offer is sent.
The full amount must be paid no later than 30 days before the event.
Late Payments for Private Events:
In case of payment delay, a late fee of €5 per reminder will be charged.
From the 30th day after the payment due date, a late payment interest of 5% above the applicable base interest rate will be charged according to Section 288 of the German Civil Code (BGB).
If full payment is not received by 30 days before the scheduled event, I reserve the right to cancel the booking. Any costs incurred will be deducted from the deposit or invoiced separately if the deposit is insufficient.
3. Cancellation Policy
Single Appointment Bookings, Bundles, and Courses:
Cancellations are allowed up to 48 hours before the initial appointment. In this case, the full payment will be refunded.
For later cancellations, no refund will be issued. However, a rescheduled appointment can be arranged if it fits into my schedule.
Private Events:
Cancellations are allowed up to 14 days before the scheduled event. Any costs already incurred will be deducted from the deposit or invoiced separately.
For cancellations within 14 days before the event, no refund will be provided. However, a rescheduled event can be arranged if it aligns with my schedule and takes place within three months of the original event date.
If I need to cancel an event (not due to the client’s payment default), a full refund of the amount paid will be issued. Further claims for damages are excluded. If desired, a rescheduled event can be offered.
4. Use of Zoom and Technical Requirements
Certain services, such as Single Appointment Bookings, Courses, and Bundles, may be conducted via Zoom. The client is responsible for:
Ensuring they meet the technical requirements (computer, tablet, smartphone, stable internet connection).
Familiarizing themselves with the Zoom platform in advance.
The client is required to arrive on time for the scheduled appointment. In the event of a delay, I will wait for a maximum of 10 minutes as a courtesy. If the client has not arrived by then, the session will be ended early, and there will be no entitlement to a refund. Any delay on the part of the client will not result in an extension of the session beyond the originally scheduled time.
I am not responsible for technical issues arising from the client’s equipment or internet connection.
If I cannot hold a session due to technical issues on my end, a rescheduled appointment will be offered.
5. Group Events
Group events cannot accommodate specific requests regarding other participants.
Groups are pre-arranged to ensure smooth organization. While I strive to create harmonious group dynamics, this cannot always be guaranteed.
Sessions are structured to encourage collaboration and mutual respect among participants.
6. Right of Withdrawal
You have the right to withdraw your booking within 14 days after the contract conclusion without providing any reason, as long as the service has not yet been rendered. Withdrawals must be submitted in writing via email to diwa-soul@web.de or by post to Cornelia März, Roßstraße 36, 47918 Tönisvorst.
Exclusion of the Right of Withdrawal:
The right of withdrawal is forfeited once the service has been fully provided or if its execution has commenced.
If the withdrawal is exercised within the 14-day period but after the service has partially begun, the cancellation terms outlined in Section 3 will apply regarding refunds or rescheduling.
7. Payment for Products Purchased During Online Sessions
If products are purchased during an online session, an invoice will be issued afterward. The products will only be delivered upon receipt of payment. Payment in such cases must be made via bank transfer. Shipping and customs fees may apply and are to be borne by the customer.
8. Disclaimer of Liability
The services offered are intended for spiritual and personal development purposes. They do not replace medical, psychological, or legal advice. I accept no liability for direct or indirect damages resulting from the use of my services.
9. Data Protection
Your personal data is processed in accordance with the privacy policy. When using external platforms such as Calendly and Stripe, personal data will be shared with these third-party providers under agreements ensuring the security of your data.
10. Changes to the T&Cs
I reserve the right to change these T&Cs at any time. The current version is available on the website.
11. Force Majeure (Acts of God)
In the event of force majeure, such as natural disasters, wars, pandemics, or comparable unforeseeable events, I reserve the right to cancel or reschedule appointments or events without liability. Refunds or rescheduled appointments will be offered in such cases.
12. Jurisdiction and Dispute Resolution
In the event of disputes, I will first seek an amicable resolution through mediation or alternative dispute resolution. If this fails, legal proceedings may be initiated at the location of my business headquarters.
